In fulfilling its obligations under 18 U.S.C. Section 2257, the proprietor and operator of this website rely on the plain language of the statute and on the well-reasoned decision of the Tenth Circuit Court of Appeals in Sundance Assoc. v. Reno, 139 F. 3rd 804 (1998). The Sundance opinion states that 28 C.F.R. Section 75.1(c)(4)(iii) must be stricken as it renders the excluded class of activities set forth in the final part of Section 2257(h)(3) "superfluous," and therefore represents an unconstitutional expansion of the class of persons covered by Section 2257.
